TERMS OF USE AGREEMENT

Welcome to The Maids! This website (the “Site”) is operated by The Maids International, LLC (“we,” “us,” “our,” or “The Maids”). The following terms and conditions (together with any documents referred to in them) (collectively, these “Terms”) apply to your use of our Site, desktop or mobile applications, online tools, portals, message boards, tracking software, and any other digital assets or utility services offered by us (collectively, our “System”).
Your use of our System means that you accept and agree to these Terms of Use. If you do not agree to these Terms, our Privacy Policy, or our Cookie Policy, you must immediately cease all use of and access to the System.
Age Eligibility & Contractual Capacity
The System is designed and intended strictly for use by individuals who are at least 13 years of age. You must be at least 13 years old to access or create an account on the System. If you are at least 13 years old but under the age of 18 (or the legal age of majority in your jurisdiction), you represent and warrant that you have reviewed these Terms with your parent or legal guardian, and that they understand and expressly agree to be bound by these Terms on your behalf. By using this System, you represent and warrant that you possess the full legal capacity to enter into a binding contract with The Maids and meet all stated eligibility requirements.
Revisions to the Terms of Use
We may revise and update these Terms of Use from time to time in our sole discretion. All revisions are effective immediately upon posting to the Site and apply to all subsequent access and operational use of the System thereafter. Your continued use of our System following the publication of revised Terms of Use signifies your absolute acceptance of and agreement to the modified terms.
Intellectual Property and Use Restrictions
You are granted a non-exclusive, non-transferable, revocable license to access and use the System strictly in accordance with these Terms. As an absolute condition of your license, you warrant that you will not utilize the System for any purpose that is unlawful, malicious, or prohibited by these provisions.
All content hosted on or embedded within the System, including text, software, technical designs, user interfaces, scripts, graphics, logos, images, audio/video configurations, as well as the unique compilation and arrangement thereof, is the exclusive property of The Maids, its independent brand franchisees, or its technical infrastructure suppliers. This content is fully protected by United States and international copyright, trademark, patent, trade secret, and other proprietary laws.
Your license permits you to use the System solely for your personal, non-commercial purposes. You must not:
- Reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any protected content found on the System, except as naturally cached by a standard web browser for enhancement display purposes.
- Modify electronic or physical copies of any materials from this site or separate any illustrations, photographs, video, or audio sequences from their accompanying textual context.
- Delete or alter any copyright, trademark, or other proprietary rights notices or attribution benchmarks from copies of materials derived from the System.
- Access or exploit any part of the System or any services/materials available through it for independent commercial or resale purposes.
Prohibited Technical Exploitations
In addition to standard usage rules, you expressly agree that you will not:
- Use the System in any manner which could damage, disable, overburden, or impair the underlying web servers, or interfere with any other third party’s ongoing use and real-time enjoyment of the System.
- Deploy any robot, spider, scraper, or other automated script, process, or analytical mechanism to access the System for any purpose, including data indexing, monitoring, scraping, harvesting, or copying any material hosted on the System.
- Introduce any digital viruses, Trojan horses, worms, logic bombs, tracking malware, ransomware, or other data payloads that are malicious or technologically harmful to our infrastructure.
- Attempt to gain unauthorized access to, interfere with, disrupt, bypass security protocols, or hack any parts of the System, the central databases or servers on which the System is stored, or any server, network infrastructure, or database connected to our network.
- Attack the System via a Denial-of-Service (DoS) attack, Distributed Denial-of-Service (DDoS) infrastructure attack, or execute manual routines that interfere with the proper transactional working of the platform.
Interactive Services and User Contributions
The System may contain interactive features, including message boards, ratings/review profiles, interactive quote request engines, community feedback panels, or links to public brand channels on third-party social media platforms (collectively, “Interactive Services”) that allow users to post, submit, publish, display, or transmit content, text, feedback, or images (collectively, “User Contributions”) on or through the System.
Any User Contribution you post or submit via the System will be considered strictly non-confidential and non-proprietary. By providing any User Contribution, you grant The Maids, our independent franchisees, and our assigned technical service providers an absolute, perpetual, irrevocable, worldwide, royalty-free, and fully sub-licensable license to use, reproduce, modify, perform, display, distribute, translate, and disclose to third parties any such material for any legitimate marketing, advertising, commercial, or operational enhancement purpose.
You represent and warrant that you own or control all rights to your User Contributions and that your contributions will comply fully with these absolute Content Standards. User Contributions must not:
- Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
- Promote sexually explicit or pornographic material, graphic violence, or systemic discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Infringe any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any other person or entity.
- Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to civil or criminal liability under applicable regulations.
- Deceive any person, advocate or promote illegal activities, or assist in any unlawful or deceptive act.
- Impersonate any individual, or misrepresent your true identity or brand affiliation with any person, corporation, or organization.
Monitoring, Enforcement, and Termination
We reserve the absolute right, but do not assume the legal obligation, to monitor, review, edit, or remove any User Contributions at any time for any or no reason in our sole discretion. We assume no liability for any action or inaction regarding transmissions, communications, or digital content provided by any user or third party. We have the right to cooperate fully with law enforcement authorities or court orders requesting or directing us to disclose the identity of anyone posting materials on the System, and we have the right to terminate or suspend your access to all or part of the System for any violation of these Terms.
Copyright Infringement Policies (DMCA Notice)
If you believe that any User Contributions or materials accessible on or from the System violate your copyright, you may request the removal of those materials from the System by submitting written notification to our designated Copyright Agent below. To be valid under the Digital Millennium Copyright Act (17 U.S.C. § 512), your written notice must include:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive copyright that is allegedly infringed;
- Clear identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (such as the specific URL);
- Your direct contact information, including your address, telephone number, and active email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is completely accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

User Accounts, Enrollment, and Password Security
To access certain highly interactive areas of the System, personalized cleaning quote engines, or specialized customer portals, you may be asked to provide specific registration criteria, payment processing details, or contact verification data. It is an absolute condition of your use of the System that all information you provide is accurate, current, and complete. You agree that all registration information is governed exclusively by our Privacy Policy.
If you choose, or are provided with, a username, password, validation PIN, or any other authentication token as part of our platform security measures, you must treat such information as strictly confidential. Your account is entirely personal to you, and you agree not to provide any other individual or entity with access to the System utilizing your credentials. You assume full liability for all bookings, commercial transactions, or communication logs executed under your profile.
You agree to notify us immediately at themaidsinfo@maids.com upon becoming aware of any unauthorized access, credential hack, or security leak. We retain the right to disable any username, profile, or password token at any time, in our sole discretion, if we believe you have breached any provision of these Terms.
The Maids Franchise System
The Maids franchise system is a retail network made up of independently owned and operated franchised and licensed businesses. The Maids’ franchisees are independent contractual operators who own and manage their own local cleaning teams, logistics, and customer accounts. These Terms of Use do not govern a customer’s localized relationship with independent franchisees regarding site-specific policies, nor do they apply to separate localized online platforms, standalone social media profiles, or custom software variations utilized directly by an independent franchise operator for their localized business operations.
Access to the System
We reserve the right to withdraw, delete, modify, or amend the System and any service, tool, or material we provide on the platform in our sole discretion without notice or prior liability. We will not be liable if for any reason all or any part of the System is unavailable at any time or for any duration. From time to time, we may restrict access to select modules or the entirety of the System to users, including registered account profiles.
Term and Termination
These Terms remain in full force and effect so long as a user continues to access or use the System, or until formally terminated by any party. The Maids may terminate this Agreement or suspend/terminate your access to the System for any reason at any time in its sole discretion, including if we believe you have acted in violation of these Terms, our Privacy Policy, or applicable regulations, or have acted with intent to abuse, threaten, or harass our personnel or any other individual. Users may terminate this agreement by permanently ceasing all use of the System.
Third-Party Services and External Links
If you utilize a digital service, application tool, or functional feature operated by an external third party that is made available or linked through our System, each respective party’s independent terms govern that unique transaction. The Maids is not responsible or legally liable for a third party’s regulatory terms, actions, data collection, or service failures.
The System may contain hyperlinks to external sites operated by third parties, including banner advertisements and sponsored links. We do not control such sites and are not responsible for their contents, accuracy, or privacy protections. Leaving the System to access third-party environments is done entirely at your own risk and subject to the terms and operating procedures of those external locations.
Geographic Restrictions
The Maids provides this System for use exclusively by individuals residing within the United States. We make no claims that the System, its localized cleaning quote algorithms, or its content is appropriate or legally accessible outside of the United States. Accessing the System from foreign territories is done entirely on your own initiative, and you assume full responsibility for compliance with all local laws and cross-border data constraints.
Reliance on Information Posted
The information presented on or through the System is made available solely for general information purposes. We do not warrant the absolute accuracy, completeness, or practical usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you, any other visitor, or by anyone who may be informed of its contents.
Indemnification
You agree to indemnify, defend, and hold harmless The Maids International, LLC, its independent brand franchisees, officers, directors, employees, agents, contractors, licensors, and assigned suppliers from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) relating to or arising out of your violation of these Terms, your misuse of the System, your User Contributions, or your violation of any third-party proprietary rights or applicable public laws. We reserve the right, at our own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with us in asserting any available defenses.
Electronic Communications
Interacting with the System, filling out online quote forms, or sending emails to us constitutes electronic communications. You expressly consent to receive ongoing electronic communications from us, and you agree that all contracts, agreements, structural notices, disclosures, and other communications that we provide to you electronically, via email, or directly through the System, satisfy any legal requirement that such communications be executed in writing.
Warranty Disclaimer and Limitation of Liability
YOU UNDERSTAND THAT WE CANNOT AND DO NOT GUARANTEE OR WARRANT THAT FILES AVAILABLE FOR DOWNLOADING FROM THE INTERNET OR THE SYSTEM WILL BE FREE OF VIRUSES, MALICIOUS CODES, OR OTHER DESTRUCTIVE DIGITAL PAYLOADS. YOU ARE ENTIRELY RESPONSIBLE FOR IMPLEMENTING SUFFICIENT SAFEGUARDS, CHECKPOINTS, AND ANTI-VIRUS PROTOCOLS TO SATISFY YOUR SPECIFIC SECURITY REQUIREMENTS FOR THE ACCURACY OF DATA INPUT AND OUTPUT, AND FOR MAINTAINING A SECURE EXTERNAL BACKUP SYSTEM FOR THE RECONSTRUCTION OF ANY LOST DATA.
THE MAIDS, ITS FRANCHISEES, AFFILIATES, LICENSORS, AND INFRASTRUCTURE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, CYBERSECURITY, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES CONTAINED WITHIN THE SYSTEM FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH SYSTEM ELEMENTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. THE MAIDS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE MAIDS, ITS FRANCHISEES, AFFILIATES, OR ASSIGNED SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, SYSTEM COLLAPSE, SECURITY BREACH, OR SYSTEM DISRUPTION, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SYSTEM, DELAYS, INABILITY TO USE THE SYSTEM, OR FAILURE TO PROVIDE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF DAMAGES. IF YOU ARE DISSATISFIED WITH THE SYSTEM, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE COMPLETED USE OF THE SYSTEM.
Governing Law, Dispute Resolution, and Jurisdiction
MANDATORY ARBITRATION
BY AGREEING TO THESE TERMS, YOU AND THE MAIDS EXPRESSLY AGREE TO WAIVE YOUR STATUTORY RIGHTS TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY PROPOSED CONSUMER CLASS ACTION LAWSUIT.
- Agreement to Arbitrate
You and The Maids agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use, the Privacy Policy, the Cookie Policy, or your ongoing relationship or technical interactions with the System (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in a traditional court of law. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than a court, and is subject to extremely restricted judicial review. The arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect, and hearings will take place exclusively in Dallas County, Texas.
- Class Action Waiver
YOU AND THE MAIDS AGREE THAT EACH PARTY MAY BRING PRIVACY OR COMMERCIAL CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR INTEGRATED CLASS MEMBER IN ANY PURPORTED CLASS ACTION, REPRESENTATIVE SYSTEM, OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any representative class proceeding unless all parties explicitly consent in writing.
- Opt-Out Right
You have the right to opt out and refuse to be bound by this mandatory arbitration and class action waiver framework. To do so, you must send a formal written notice of your decision to opt out to themaidsinfo@maids.com within thirty (30) days of your very first tracking interaction or use of the System. Your notice must include your full legal name, current mailing address, and a distinct, unambiguous statement that you wish to opt out of arbitration. If a valid opt-out is received, the judicial jurisdiction terms below will apply.
- Governing Law and Choice of Forum
These Terms shall be treated as though they were executed and performed in the State of Texas. All matters arising out of or relating to these Terms or the System shall be governed by and construed in accordance with the internal laws of the State of Texas and applicable laws of the United States, without giving effect to any choice or conflict of law principles. Any legal suit, action, or proceeding that is exempted from arbitration or subject to a valid opt-out notice must be instituted exclusively in the state or federal courts located within the County of Dallas, in the State of Texas, and you irrevocably submit to the personal jurisdiction of such courts.
Any statutory claim or dispute related to the System or under these Terms must be formally instituted within one (1) year after the underlying claim arose (or for multiple claims, from the date the first claim arose), or be forever waived and barred from recovery.
Miscellaneous Terms
These Terms of Use, together with our Privacy Policy and Cookie Policy, constitute the entire legal agreement between you and The Maids regarding your use of the System. No waiver of these Terms by us shall be deemed a further or continuing waiver of such term or condition, and any failure by us to assert a right or provision shall not constitute a waiver of that right.
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of the Terms of Use will continue in full force and effect.
